Terms of Service (Maroon Mercantile)

These Terms of Service (“Terms”) govern your use of maroonmercantile.com (the “Site”) and any purchases or services provided by Maroon Mercantile (“we,” “us,” “our”). By accessing the Site or placing an order, you agree to these Terms.

1) Use of the Site

You agree to use the Site for lawful purposes only and not to misuse the Site, attempt unauthorized access, interfere with operations, or violate any applicable laws.

2) Orders and acceptance

All orders are subject to acceptance and availability. We may refuse, cancel, or limit any order at our discretion, including due to suspected fraud, errors, or inventory/fulfillment constraints. If we cancel an order after you’ve been charged, we will issue a refund to your original payment method.

3) Product information and pricing

We try to display product descriptions, colors, and images as accurately as possible. However, colors and appearance may vary due to your device or display settings.

Prices and availability are subject to change without notice. The price charged will be the price shown at checkout at the time the order is placed.

4) Payment

Payments are processed through third-party payment providers. By submitting payment information, you represent that you are authorized to use the payment method. We do not store full payment card information.

5) Shipping and delivery

Estimated delivery dates are not guaranteed. Many items are made to order and require production time before shipping. Once an order has been handed off to a carrier, shipping delays may occur outside our control.

You are responsible for providing an accurate shipping address. If an order is returned due to an incorrect or incomplete address, we may be unable to reship it without additional postage and/or re-fulfillment costs.

6) Returns, refunds, and exchanges

Because many items are made to order, we do not accept returns or exchanges for change of mind or incorrect size selection, unless otherwise stated on the product page.

Damaged/defective/wrong item: If your order arrives damaged, defective, misprinted, or incorrect, contact us within 7 days of delivery at support@maroonmercantile.com with your order number and clear photos of the issue (and packaging if damaged). If approved, we will provide a replacement or refund at no cost to you.

Do not send items back without contacting us first. If a return is required, we will provide return instructions.

7) Promotions and discount codes

Discount codes and promotions may have restrictions, expiration dates, and may not be combined unless explicitly stated. We reserve the right to modify or end promotions at any time.

8) Intellectual property

All content on the Site—including text, graphics, logos, product designs, photos, and other materials—is owned by or licensed to Maroon Mercantile and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission.

9) User content (reviews, comments, messages)

If you submit reviews, comments, photos, or other content to us (including via social media tagging), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute that content for business purposes (such as marketing), unless you request otherwise in writing.

You agree not to submit content that is unlawful, defamatory, infringing, or harmful.

10) Disclaimers

The Site and products are provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted, error-free, or secure.

11) Limitation of liability

To the fullest extent permitted by law, Maroon Mercantile will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of the Site or products.

Our total liability for any claim relating to a product or order will not exceed the amount you paid for the applicable order.

12) Indemnification

You agree to indemnify and hold harmless Maroon Mercantile from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of any rights of a third party.

13) Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

14) Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on the Site and update the effective date above. Your continued use of the Site after changes constitutes acceptance of the updated Terms.
